Glossary of terms
- You / Your / Yours
- The hirer of the vehicle as recorded on this agreement, and any additional drivers recorded on it.
- We / Our / Us
- Universal Cool Campers and its employees and agents.
- The Parties
- The hirer, any additional drivers, and Universal Cool Campers and its employees and agents.
- Agreement
- The entirety of the hire agreement, including the first page with details of the hirer, the vehicle and any charges, and every part and page of these terms and conditions, all of which form the entire agreement between the parties.
- Hire
- The provision to you of the vehicle by us under the terms of this agreement.
- Vehicle
- The vehicle provided to you by us under the terms of this agreement.
- Charges
- Any and all charges levied for the hire of the vehicle, mandatory, elective or refundable, including deposits, daily rates, additional extras and penalty charges.
- Accessories
- Any supplemental or additional item provided as part of the hire that does not form part of the vehicle itself.
- Damage
- Any loss or defect arising while the vehicle is in your care, whether cosmetic, electrical or mechanical, that means the vehicle is no longer in the same condition as when we provided it.
Hire of the vehicle
1. Collection and return of vehicle
- a)You must collect the vehicle as agreed on the day hire begins. Please allow at least 30 minutes for us to demonstrate the workings of the vehicle and its accessories.
- b)You must return the vehicle on the final agreed day, clean and in the same condition as when collected, with a full tank of the correct fuel type. If not, a charge will be levied, in the first instance from your security deposit.
- c)If the vehicle is involved in an accident causing damage to itself or third party property, you are liable for the policy excess: 23 to 75 years old, UK hire and residency, £500.
- d)If you will be late returning the vehicle, you must tell us immediately. Failure to do so may mean you are driving uninsured, which may lead to prosecution. All late returns are charged at £100 per hour.
- e)If you lose the use of the vehicle for any reason during the hire, we are not obliged to refund any money paid or to provide a replacement.
2. Drivers
- a)All drivers must be aged 23 to 75 and have held a full valid driving licence for two years. We reserve the right to refuse hire to any driver without explanation.
- b)A copy of the photo card driving licence (address and ID up to date) must be provided by all drivers.
- c)An online licence check must be completed and a copy sent to Universal Cool Campers for all drivers.
- d)Each driver must provide two proofs of address from separate sources: electricity, water, gas, broadband or landline, council tax, TV licence, bank statement, credit card statement, mortgage statement, polling card, HMRC self-assessment or tax credits, student loan, shotgun licence, payslip, mobile phone bill, pension letters, car finance settlement, loan statement or property deed. An annual council tax bill is accepted; all other documents must be dated within 90 days of the hire date.
- e)A cleared and traceable security deposit is required.
- f)The hire agreement form must be signed by the customer and Universal Cool Campers.
- g)Details of any additional drivers are required at least 7 days before hire begins.
- h)Drivers are personally liable for any legal penalties incurred during the hire, except where those penalties reflect the condition of the vehicle at the point of hire. For motoring offences such as speeding or parking infringements, the hirer's contact details will be passed to the appropriate issuer.
3. Use of the vehicle
The vehicle is not to be: driven in an unsafe, reckless or dangerous manner; used in a way that could damage the vehicle, its passengers or third parties or their property; driven by anyone under the influence of alcohol or drugs or over the legal limit; driven by anyone not authorised by us; driven by anyone under 23; driven by anyone not legally entitled to drive a vehicle of this type; driven by anyone without a full valid licence; left unoccupied with the keys in or on it; submerged in or exposed to salt water; used for any illegal purpose, race, rally or contest; used to tow; used to carry passengers or property for hire and reward; used to carry more passengers or property than permitted; used to carry volatile material; used in any way that breaches the hire agreement.
Smoking in or near the campervan or awning is not permitted. The campervan must not be lent or hired to a third party, must not carry more passengers than its permitted capacity, must not be moved out of the permitted UK mainland counties without written consent, and must not be driven on non-standard roads or in extreme weather as defined by the hire company.
4. Smoking in the vehicle
Smoking of any kind is banned in or near our vehicles and awnings. A deduction will be made from your security deposit if there is evidence of smoking on return.
5. Taking pets
- a)If you wish to bring a pet, please book a campervan permitted to carry pets. We reserve the right to refuse pets at our discretion and without explanation.
- b)If your pet damages the interior or accessories, the cost is deducted from your security deposit in the first instance. Taking a pet in a pet-free campervan incurs an automatic £100 cleaning fee from your security deposit.
6. Modifications to the vehicle
You will not make any modification to the vehicle's exterior, interior, mechanical or electrical workings or accessories without our prior consent.
7. Maintenance of the vehicle
- a)You will keep the vehicle properly maintained while in your care, including checking oil and water levels daily and ensuring the tyres are safe before moving off.
- b)Regular battery checks are essential. Do not run the battery for extended periods to power equipment or accessories.
- c)Provided the fault is not due to your actions or any breach of these terms, we will reimburse up to £50 for proportionate and reasonable mechanical repair costs, on receipted documentation and with our prior consent to the work.
- d)Do not discharge the leisure battery below 12 volts.
Charges and payments
8. Making payment
You must confirm availability with us at the time of booking. A booking is only confirmed once a non-returnable booking fee of £150 is received, at which point your confirmation email is sent. The balance must then be paid in full 4 weeks before the first day of hire. If you book within 4 weeks of the first day of hire, full payment is due at the time of booking.
9. Cancellations and charges
- a)If you cancel before hire begins, you lose the non-refundable £150 booking fee.
- b)If cancellation occurs within 4 weeks of the start of hire, you are liable for the full hire charge.
- c)Gift vouchers are non-refundable and non-transferable, including any unspent sums.
- d)If your hire cannot proceed because of legal government restrictions such as a local or national lockdown, we will offer a change of date with the full value transferred. If alternative dates are not yet known, we will issue a gift voucher to the full value paid, with no expiry or restriction on use.
10. Your security deposit
A £500 security deposit (23 to 75 years old, UK hire and residency) is payable on collection. It is fully refundable on return of the vehicle, provided it and any accessories are delivered on time and in the same condition as when they left, with a full tank of the correct fuel type.
- b)The deposit is refunded within 7 days of these conditions being met.
- c)Late returns are charged at £100 per hour, as the vehicle must be cleaned, valeted and re-stocked before the next customer.
- d)If damage to the interior or accessories exceeds the security deposit, you are liable for the additional costs.
- e)If damage does not exceed the deposit, we charge only the amount required to put the damage right and return the remainder.
11. Chargeable insurance extras
Insurance for additional drivers is charged at £10 per additional driver per day (in whole or in part), with a maximum of two drivers. We reserve the right to refuse hire to any driver without explanation.
Insurance
12. Vehicle insurance
- a)Comprehensive cover is included in the stated price, with a standard excess of £500 (payable for any accident damage to the vehicle or third party property). You are liable for this excess, and for the repair or replacement of any windscreen or tyre damage.
- b)Drivers must be at least 23 years old to be covered. We will not allow any additional driver below this age.
- c)Repair costs below the insurance excess are invoiced directly to the hirer. An insurance claim is only made if the total repair cost exceeds £500.
- d)Not covered: fire damage; minor exterior paintwork damage with total repair costs under £750; personal effects in or from the vehicle; interior damage including burns to seats, flooring and living or cooking equipment; any equipment on hire; any consequential expenses or costs of hiring alternative vehicles; missed transport, accommodation, travel expenses or third party claims connected with a breakdown or accident. The hirer is liable for the full cost of repairing any damage the campervan suffers through accidental damage or the hirer's wilful or negligent action.
13. Cleaning
- a)You are expected to sweep out any debris and wipe down all internal surfaces before returning the vehicle.
- b)You agree to return the van not unreasonably dirty on the outside. Please do not contact wash the exterior.
Accidents and breakdowns
14. In the event of an accident
- a)If an accident, loss or damage occurs while the vehicle is in your care, you must inform us within 24 hours.
- b)Any theft, road traffic accident or damage to third party property must be reported to the local police. You must obtain names, addresses and telephone numbers for all third parties and witnesses, even if the matter appears straightforward or the damage minimal.
- c)By signing the agreement, you undertake to assist us and our representatives with any claim arising from any accident or event while the vehicle is in your care, including completing report forms and witness statements, being interviewed, and attending court to give evidence.
15. Breakdown and recovery
- a)In the event of a breakdown that leaves the vehicle immobile, you must telephone us immediately.
Rights of the parties
16. Road and weather restrictions
We reserve the right, at our discretion, to restrict hire in certain locations, at certain times or in certain circumstances due to adverse or unsafe road or weather conditions.
17. Substitution of vehicle
We reserve the right to substitute the booked vehicle with an alternative at our discretion and without consultation.
18. Ending the hire agreement
- a)We may end this agreement and take back the vehicle at any time, for any reason, without notice.
- b)Reasons may include: any breach of this agreement; misrepresentation of yourself or your circumstances; the vehicle being abandoned; the vehicle not being returned on the agreed date or reasonable cause to believe it will not be; or reasonable cause to believe the vehicle is being used unsafely or dangerously.
- c)If the agreement is ended this way, you are not entitled to a refund of any part of the hire charges or security deposit.
19. Title to the vehicle
- a)You acknowledge that we hold title to the vehicle and that you act as hirer only. No part of this agreement gives you any right to pledge our credit or cooperation in connection with the vehicle, and you agree not to do so.
- b)You will not sell, lend, hire or assign any part of the vehicle, its accessories or this agreement to any party, or otherwise deal with the vehicle in any way not allowed by this agreement.
20. Release and indemnity
- a)Subject to our obligation to deliver the vehicle or a suitable substitute, you release us, our employees, servants and agents from any liability for any loss or damage incurred by you or a third party through your use or possession of the vehicle, including loss or damage from breakdown, mechanical defect, accident or unsuitability, and any loss or damage to property left in or on the vehicle or on our premises.
- b)Subject to any insurance arrangements agreed with us, you agree to indemnify us, our employees and agents against any claims, demands and expenses, including legal costs, incurred by you or a third party through your use or possession of the vehicle.
21. This agreement
- a)Any alterations or amendments must be made in writing and signed by the parties.
- b)This agreement is governed by English law and constitutes the entire agreement between the parties. No additional oral undertakings, warranties or agreements can supersede these terms without the parties' prior consent.
- c)We reserve the right to add or amend any charges referred to in this agreement without prior notice.
22. Customer parking
- a)Customer cars are parked at their own risk.
